LICENSE TO DRIVE – 2026 VICTORY Ball Vehicle Raffle Official Rules
Participation in the License To Drive 2026 VICTORY Ball Vehicle Raffle (the “Raffle”) is governed by these Official Rules and the State of Texas - Charitable Raffle Enabling Act (CREA).
OFFICIAL DRAWING. The official drawing will take place on SATURDAY, APRIL 25, 2026, at approximately 10:00 PM at the 2026 VICTORY Ball at the 713 Music Hall (401 Franklin, Ste. 1600, Houston, TX 77201).
SPONSOR. The Raffle is sponsored by VICTORY Houston, Inc. (“VICTORY” or “Sponsor”), an eligible Texas non-profit corporation. All decisions of the Sponsor are final.
ELIGIBILITY. Participation in the Raffle is open only to natural persons who are legal residents of Texas eighteen (18) years of age or older as of date of the ticket purchase. VICTORY is not responsible for late, lost, damaged, incomplete, erroneous, misdirected, illegible, or mutilated entries. Winner must present a valid driver’s license and proof of automobile liability insurance as may be required by law before taking delivery of the Prize. VICTORY reserves the right to revoke any prize or disqualify any ticket if the Entrant does not meet any or all of the eligibility requirements, or if the purchased ticket has been compromised in any fashion, all as may be determined by VICTORY in its sole discretion. The Raffle and eligibility to participate in same is subject to all applicable federal, state, and local laws and regulations.
Please note: You must be over the age of 18 and a Texas resident to purchase tickets. Proceeds from tickets purchased by non-Texas residents will be considered a donation to the VICTORY Houston, Inc.
TO ENTER. From Monday, December 15, 2025 at 12:00 PM CST until April 25, 2026 at 9:45 PM CST, or until 2,500 tickets have been sold, (the “Raffle Entry Period”), entrants may purchase one (1) ticket for $50 or six (6) tickets for $250 from an authorized agent of VICTORY and online at www.victory-houston.org by completing an online registration which will include name, complete address, city, state, zip code, e-mail address (if available), and telephone number. A maximum of 2,500 tickets will be sold. Odds of winning are based on the number of Raffle tickets sold.
Please Note: The deadline to purchase tickets is 9:45 PM on Saturday, April 25, 2026, or until 2500 tickets are sold.
SELECTION AND NOTIFICATION OF WINNERS. The winning ticket will be selected by a random drawing from among all eligible tickets received by Saturday, April 25, 2026, at the VICTORY Ball. The holder of the winning ticket (the “Winner”) will be entitled to claim the Raffle Prize subject to all terms and conditions of the Official Rules only once eligibility and compliance with the Rules is confirmed by Sponsor. Winner need not be present to win and will be notified by telephone, mail, and/or email. If contact with the Winner cannot be confirmed within ten (10) days after first notification attempt, if any prize notification is returned as undeliverable, or if the Winner or the ticket is found to be ineligible, the Prize will be forfeited, and an alternate winner selected by random drawing from the remaining tickets sold. The number of notification attempts will not exceed that deemed reasonable by VICTORY in its sole discretion. VICTORY is not responsible for any communication failures (whether electronic, mail, or otherwise) which may affect Winner’s receipt of the prize notification.
PRIZE: There is one (1) prize (the "Prize" or the "Vehicle"). The holder of the winning ticket will receive their choice of one (1) of the following vehicles including:
- 2026 Chevrolet Equinox RS from the Lone Star Chevrolet Dealership
- 2026 Ford Bronco Sport from the Baytown Ford Dealership
- 2026 Harley-Davidson Street Glide from the Mancuso HD Crossroads Dealership
- 2026 Hyundai Sonata from the Philpott Hyundai Dealership
- 2026 Toyota Camry SE from the Philpott Toyota Dealership
- 2026 Volkswagen Tiguan 2.0T S from the Momentum Volkswagen Dealership

To the best of VICTORY’s knowledge, the Vehicle is new; however, the Winner takes the Vehicle as-is, where-is, and with all faults and defects, and is solely responsible for inspecting the Vehicle prior to accepting or operating the Vehicle.
There are no representations, guarantees, or warranties in connection with the Prize, express or implied, which extend beyond the description on the face hereof, including but not limited to warranties of merchantability, and fitness of purpose, and no affirmation of VICTORY by words and/or actions will constitute a warranty. The value of the Vehicle for tax reporting purposes will be determined by Sponsor in its sole discretion and may be based on recent sales or offering prices of Vehicles of similar age and characteristics as identified and assessed by Sponsor in its sole discretion, but VICTORY makes no representation or warranty regarding the value or resale price of the Vehicle. VICTORY is not responsible for any change in the value of the Vehicle either before or after the Raffle. Prize does not include tax, title, license, or any other fees necessary to transfer ownership and possession. VICTORY is not responsible for any gasoline, maintenance, or repair costs on the Vehicle after transfer to the Winner and is not required to conduct any maintenance or repair prior to the transfer. All expenses not specifically described are the sole responsibility of the Winner. The Prize is non-transferable and may not be redeemed for cash. The prize may be upgraded. The winner will pay the price difference plus any additional applicable fees and taxes.
TAXES, FEES, AND DELIVERY. The Winner will be required to sign an Affidavit of Eligibility and Publicity/Liability Release, present proof of a valid driver’s license, and provide any and all other documentation and information required by these Official Rules in order to claim the Prize. Failure or refusal to meet all requirements of the Official Rules will constitute a forfeiture, and another winner will be selected via random drawing of the remaining tickets. Prize Winner is responsible for all title and license fees necessary to effect transfer of the Vehicle to the Winner. All local, state, and federal taxes are the sole responsibility of the Winner. VICTORY reserves the right to file such tax reporting documents at such times as VICTORY may determine in its sole discretion (including without limitation an IRS Form 1099 or similar document reporting the value of the prize less any ticket price paid as income to the Winner). Prior to accepting Vehicle, Winner may be required to submit evidence of tax identification number and any relevant withholding status to VICTORY, including without limitation a completed and signed IRS Form W-9, which will be used for tax recording purposes only and will not be used or released for any other purposes. VICTORY reserves the right to file such tax reporting documents at such times as VICTORY may determine in its sole discretion (including without limitation an IRS Form 1099, W-2G, or similar document reporting the value of the prize less any ticket price paid as income to the Winner).
INDEMNIFICATION & LIMIT OF LIABILITY. By purchasing a ticket (and as a condition of accepting the Prize), Entrant agrees to forever waive, release, discharge, and hold harmless VICTORY and its subsidiaries, affiliated entities, agents, directors, contractors, representatives, sponsors, beneficiaries, volunteers, retailers, advertising, and raffle agencies, and all of their respective shareholders, officers, directors, employees and assigns, members, representatives and agents (the “Released Parties”), and agrees that the Released Parties will have no liability whatsoever for, any liability for any harm, bodily injury, loss, cost, or damages of any kind to persons, whether direct, compensatory, incidental, or consequential, including death, bodily harm, injury to property, theft, or other damages sustained due in whole or in part, directly or indirectly, from: ticket purchase and entry creation; the acceptance, possession, use, or misuse of the Prize or parts thereof, if applicable; or participation in the Raffle or participation in any Raffle related activity, including any travel to or attendance at the 2026 VICTORY Ball, location of ticket sales, or location of transfer of ownership of the Prize. The released and indemnified harms, injuries, and damages include but are not limited to occurrences beyond the control of VICTORY, CAUSES THAT MAY BE PARTIALLY OR WHOLLY THE RESULT OF VICTORY’S NEGLIGENCE, or the failure of any automobile manufacturer’s or dealership’s warranties. Entrants further agree that in any cause of action, the Released Parties’ total liability will be limited to the Entrant’s cost of entering and participating in the Raffle, and in no event shall the Released Parties be liable for attorneys’ fees. Entrants waive the right to claim any damages whatsoever, including, but not limited to, punitive, consequential, special, direct, or indirect damages arising in tort, contract, or otherwise. THE WINNER FURTHER AGREES TO DEFEND, INDEMNIFY, AND HOLD HARMLESS THE RELEASED PARTIES FROM ANY AND ALL THIRD-PARTY CLAIMS ARISING FROM, IN CONNECTION WITH, OR AS A RESULT OF WINNER’S PARTICIPATION IN THE RAFFLE OR WINNING, ACCEPTING, POSSESSING, USING OR MISUSING THE PRIZE.
In connection with the releases provided for in these Official Rules, each Entrant expressly waives, releases, and forever discharges any and all provisions, rights, and benefits conferred by any law of any State or territory of the United States or other jurisdiction, or principle of common law, which is similar, comparable, or equivalent to § 1542 of the California Civil Code, which reads:
“General Release; extent. A general release does not extend to claims that the creditor or releasing party does not know or suspect to exist in his or her favor at the time of executing the release and that if known by him or her, would have materially affected his or her settlement with the debtor or released party.”
Any controversy or claim arising out of or relating to the raffle shall be settled by binding arbitration administered by the American Arbitration Association (pursuant to its expedited procedures) under its commercial arbitration rules, and judgment on the award rendered by the arbitrator may be entered in any court having jurisdiction thereof. Any such arbitration shall take place in Houston, Texas. The Raffle and these Rules shall be subject to and governed by the laws of the State of Texas, without regard to its conflict of laws provisions.
GENERAL. Raffle void where prohibited and subject to all applicable laws and regulations. This Raffle and any website pages, advertisements, documents, or signage relating thereto are intended for viewing only within the greater Houston area which includes the following counties: Austin, Brazoria, Chambers, Fort Bend, Galveston, Harris, Liberty, Montgomery, San Jacinto, and Waller.
By purchasing a ticket or accepting a Prize, Entrants hereby represent and warrant that they have read these Official Rules and are fully familiar with the contents and agree to be bound by these Official Rules and by all decisions of VICTORY with respect to the Raffle. Ticket purchases are not tax deductible or refundable. The Prize is non-transferable and cannot be redeemed for cash. VICTORY may use Winner’s name and likeness for publicity purposes without further compensation, unless prohibited by law, and Winner agrees to confirm that understanding in writing upon request. VICTORY is not responsible for: (i) electronic or digital entries or notifications that are lost, late, stolen, incomplete, illegible, damaged, garbled, destroyed, misdirected, filtered, or captured; (ii) any problems or technical malfunctions, errors, omissions, interruptions, deletions, defects, delays in operation of transmission, communication failures, destruction or unauthorized access to, or alteration of, entries; (iii) failed or unavailable hardware, network, software or telephone transmissions, damage to entrants' or any person's computer and/or its contents, or causes beyond Sponsor's reasonable control that disrupt the administration, security, fairness, integrity or proper conduct of the Raffle; (iv) any entries submitted in a manner that is not expressly allowed under these rules; (v) incorrect or inaccurate entry information whether caused by entrants or by any of the equipment or programming associated with or utilized in the Raffle; (vi) any typographical or other error in the printing or advertising of the offer, administration or execution of the Raffle, or in the announcement of prizes/prize winner; or (vii) malfunctions or interference resulting from illicit, malicious or injurious code (including but not limited to viruses, worms, and denial of service attacks). VICTORY reserves the right to modify these rules without prior notice and to post any rule changes at the Ball prior to the drawing. All decisions of VICTORY are final and binding in all matters related to this Raffle. Any attempt by any person to undermine the legitimate operation of the Raffle may be a violation of criminal and civil law and, should such an attempt be made, VICTORY reserves the right to seek damages from any such person to the fullest extent permitted by law. VICTORY’ failure to enforce any provision of these Official Rules shall not constitute a waiver of that provision. Invalidity of any provision of the Official Rules shall not affect any other portion thereof.
FORCE MAJEURE, CANCELLATION, AND DISQUALIFICATION. VICTORY will not be liable for inadequate performance to the extent caused by a condition (for example, natural disaster, act of war or terrorism, riot, labor condition, governmental action, and Internet disturbance) that was beyond VICTORY’s reasonable control. Additionally, by purchasing a Raffle ticket and choosing to participate in the Raffle, each Entrant acknowledges and agrees that VICTORY has the right, in its sole discretion, to elect not to proceed with the Raffle for any reason whatsoever or for no reason, and in such event, an Entrant’s sole and exclusive remedy shall be to receive a refund of the full price paid by such Entrant for each Raffle ticket purchased, without interest. VICTORY reserves the right to disqualify any Entrant found to be disrupting the operation of the Raffle, found to be in violation of the Official Rules, or whose form of payment is invalid or dishonored by the bank and/or credit card company, and to select a winner from the remaining tickets.
